The family of Allan Feliz, a Washington Heights man fatally shot by a police officer during a Bronx traffic stop in 2019, is suing the NYPD and its Commissioner, Jessica Tisch.
The lawsuit aims to overturn Tisch's decision to overrule a judge's recommendation to fire the officer involved, Lt. Rivera. A departmental trial found that Rivera was not justified in shooting 31-year-old Feliz as he tried to flee the stop, which was initially made over an allegedly undone seatbelt.
The family says Feliz's "mother, brother, and sister live in fear of the police."
NYPD Judge Rosemarie Maldonado sided with the Civilian Complaint Review Board, the city's police watchdog body, in finding Rivera's actions unjustified. However, Tisch concluded that Rivera acted reasonably, fearing that Feliz would injure other officers as they struggled in the vehicle.
