Judge Pauses Florida Medical Marijuana Gun Rights Case as Supreme Court Takes Up Similar Challenge

Judge Pauses Florida Medical Marijuana Gun Rights Case

A federal judge in Florida has paused a long-running lawsuit over whether medical marijuana patients can be barred from owning firearms, citing a pending U.S. Supreme Court case that centers on the same federal law.

Chief U.S. District Judge Allen Winsor issued the stay, halting the Florida case until the Supreme Court rules in United States v. Hemani, a Texas case that will test whether a law prohibiting “unlawful users” of controlled substances from possessing guns violates the Second Amendment.

the Supreme Court’s decision in Hemani will “almost certainly have a significant impact” on the Florida case.

Department of Justice attorneys argued this in their motion.
